Ankara \u00dcniversitesi Deniz Hukuku Ara\u015ft\u0131rma Merkezinin (DEHUKAM) akademik deste\u011fiyle ger\u00e7ekle\u015ftirilen toplant\u0131da T\u00fcrkiye&#8217;yi de yak\u0131ndan ilgilendiren karasular\u0131ndan, m\u00fcnhas\u0131r ekonomik b\u00f6lgeye bir\u00e7ok konu hakk\u0131nda 42 \u00fclkeden gelen kat\u0131l\u0131mc\u0131lar taraf\u0131ndan tebli\u011fler sunuldu.T\u00fcrkiye&#8217;nin mill\u00ee menfaatleri aras\u0131nda \u00e7ok \u00f6nemli bir yer i\u015fgal eden deniz egemenlik ve yetki alanlar\u0131n\u0131n ve \u00f6zel olarak Mavi Vatan konseptinin de t\u00fcm detaylar\u0131yla ele al\u0131nd\u0131\u011f\u0131 s\u00f6z konusu toplant\u0131n\u0131n oturum aralar\u0131ndaki en pop\u00fcler tart\u0131\u015fma konular\u0131ndan biri ge\u00e7en hafta bas\u0131nda yer alan \u0130stanbul Bo\u011faz\u0131&#8217;n\u0131n trafi\u011fe kapat\u0131laca\u011f\u0131 haberiydi. Bo\u011faz&#8217;\u0131n 6 Kas\u0131m&#8217;da gemi ge\u00e7i\u015f trafi\u011fine kim taraf\u0131ndan, neden kapat\u0131laca\u011f\u0131, bunun Montr\u00f6 S\u00f6zle\u015fmesi&#8217;ne uygun olup olmad\u0131\u011f\u0131 hakk\u0131nda \u00e7e\u015fitli g\u00f6r\u00fc\u015fler ileri s\u00fcr\u00fcld\u00fc.<\/p>\n<p>Tart\u0131\u015fmalara konu olan ve asl\u0131nda son derece &#8220;tuhaf&#8221; kapatma hik\u00e2yesinin \u00f6z\u00fc \u015fu:<\/p>\n<p>7 Eyl\u00fcl 2022&#8217;de Poyrazk\u00f6y Su \u00dcr\u00fcnleri Kooperatifi, Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131na ba\u015fvurarak &#8220;\u0130stanbul Bo\u011faz\u0131&#8217;nda ekonomik de\u011feri y\u00fcksek olan palamut, l\u00fcfer, \u00e7inekop, torik ve hamsi gibi bal\u0131klar\u0131n Bo\u011faz ge\u00e7i\u015flerinin ekim-kas\u0131m d\u00f6neminde yo\u011fun olarak ya\u015fand\u0131\u011f\u0131 ve bal\u0131k avc\u0131l\u0131\u011f\u0131n\u0131n yasak olmas\u0131 nedeniyle su \u00fcr\u00fcnleri avc\u0131l\u0131\u011f\u0131n\u0131n yap\u0131lamad\u0131\u011f\u0131ndan bahisle bal\u0131k ge\u00e7i\u015finin ya\u015fand\u0131\u011f\u0131 ekim-kas\u0131m d\u00f6neminde belirli g\u00fcn ve saatlerde T\u00fcrk Bo\u011fazlar\u0131nda bal\u0131k avc\u0131l\u0131\u011f\u0131n\u0131n serbest b\u0131rak\u0131lmas\u0131n\u0131&#8221; talep etti.<\/p>\n<p>Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131 taraf\u0131ndan 26 Ekim&#8217;de da\u011f\u0131t\u0131ma sunulan &#8220;\u0130stanbul Bo\u011faz\u0131nda Bal\u0131k Avc\u0131l\u0131\u011f\u0131&#8221; konulu ve Poyrazk\u00f6y Kooperatifinin mezkur yaz\u0131s\u0131n\u0131n ilgi tutuldu\u011fu yaz\u0131da &#8220;\u0130stanbul Bo\u011faz\u0131&#8217;nda deniz trafi\u011fine \u00e7apariz verilmemesi (gemi manevralar\u0131n\u0131n engellenmemesi) amac\u0131yla [&#8230;] \u0130stanbul Bo\u011faz\u0131&#8217;n\u0131n tek sefere mahsus olarak 06 Kas\u0131m 2022 tarihinde 00.01-14.00 saatleri aras\u0131nda ticari gemi ge\u00e7i\u015f trafi\u011fine kapat\u0131larak bal\u0131k avc\u0131l\u0131\u011f\u0131 i\u00e7in bal\u0131k avlama tekne \/ gemilerine a\u00e7\u0131lmas\u0131 talebi&#8221; uygun bulundu.<\/p>\n<p>Yani Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131 \u0130stanbul Bo\u011faz\u0131&#8217;n\u0131 -end\u00fcstriyel bal\u0131k avc\u0131l\u0131\u011f\u0131 yap\u0131labilmesi i\u00e7in-14 saatli\u011fine trafi\u011fe kapatma karar\u0131 ald\u0131. Bu karar \u00fc\u00e7 temel s\u0131k\u0131nt\u0131ya sebep oldu:<\/p>\n<p>Birincisi, b\u00fcy\u00fck bal\u0131k avlama gemilerinin Bo\u011faz&#8217;a girecek olu\u015fu \u00e7evreci bir tepki meydana getirdi. Sosyal medyada baz\u0131 \u00e7evreci \u00f6rg\u00fctler ve<\/p>\n<p>amat\u00f6r bal\u0131k\u00e7\u0131lar 6 Kas\u0131m&#8217;da Bo\u011faz&#8217;da eylem yapmay\u0131 tart\u0131\u015fmaya ba\u015flad\u0131lar.<\/p>\n<p>\u0130kincisi, Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131n\u0131n Bo\u011faz&#8217;\u0131 kapatma yetkisi olup olmad\u0131\u011f\u0131 sorgulanmaya ba\u015flad\u0131. Her ne kadar Denizcilik Genel M\u00fcd\u00fcr\u00fc imzas\u0131yla 1 Kas\u0131m&#8217;da yay\u0131mlanan bir yaz\u0131da, &#8220;T\u00fcrk Bo\u011fazlar\u0131 Deniz Trafik D\u00fczeni Y\u00f6netmeli\u011fi&#8221; h\u00fck\u00fcmlerine g\u00f6re &#8220;T\u00fcrk Bo\u011fazlar\u0131n\u0131n deniz trafi\u011fine kapat\u0131lmas\u0131 bakanl\u0131\u011f\u0131m\u0131z\u0131n yetkisindedir&#8221; denilse de bu ifadede mevcut bir problem uzmanlar taraf\u0131ndan hemen fark edildi. Zira ilgili y\u00f6netmelik bakanl\u0131\u011fa &#8220;ne zaman isterse Bo\u011fazlar\u0131 kapatma yetkisi&#8221; vermemekte ve Y\u00f6netmeli\u011fin &#8220;Trafi\u011fin Ge\u00e7ici Olarak Durdurulmas\u0131&#8221; ba\u015fl\u0131kl\u0131 21. maddesinde, &#8220;bal\u0131k avc\u0131l\u0131\u011f\u0131&#8221; kapatma gerek\u00e7eleri aras\u0131nda say\u0131lmamaktayd\u0131. Uluslararas\u0131 bir s\u00f6zle\u015fme olan Montr\u00f6 h\u00fck\u00fcmleriyle teminat alt\u0131na al\u0131nm\u0131\u015f ge\u00e7i\u015f serbestisinin, ne uluslararas\u0131 ne de ulusal bir mevzuatta yer alan bir gerek\u00e7eyle s\u0131n\u0131rland\u0131r\u0131lmas\u0131 uluslararas\u0131 hukuk problemlerine sebep olabilirdi. Dahas\u0131, D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131na bu konuda g\u00f6r\u00fc\u015f dahi sorulmam\u0131\u015ft\u0131.<\/p>\n<p>\u00dc\u00e7\u00fcnc\u00fcs\u00fc, 26 Ekim tarihli karar T\u00fcrk denizlerinde d\u00fczen sa\u011flama ve uygulamayla ilgili taraflar\u0131n yetki ve sorumluluk alanlar\u0131 konusunda bir e\u015f g\u00fcd\u00fcm eksikli\u011fi oldu\u011funu da g\u00f6zler \u00f6n\u00fcne sermekteydi.<\/p>\n<p>Nitekim, Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 Su \u00dcr\u00fcnler ve Bal\u0131k\u00e7\u0131l\u0131k Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc 1 Kas\u0131m&#8217;da yapt\u0131\u011f\u0131 bir kamuoyu duyurusunda, Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131n\u0131n -Bo\u011faz&#8217;da bal\u0131k avc\u0131l\u0131\u011f\u0131 i\u00e7in Bo\u011faz&#8217;\u0131 kapatma- karar\u0131na at\u0131f yap\u0131larak &#8220;\u00d6nemli bir biyolojik koridor olan \u0130stanbul Bo\u011faz\u0131, 1380 say\u0131l\u0131 Su \u00dcr\u00fcnleri Kanunu&#8217;na g\u00f6re \u00e7\u0131kar\u0131lm\u0131\u015f tebli\u011fler kapsam\u0131nda uzun y\u0131llard\u0131r koruma alt\u0131ndad\u0131r. Bal\u0131k\u00e7\u0131lar\u0131m\u0131z 5 \/1 say\u0131l\u0131 Ticari Bal\u0131k Avc\u0131l\u0131\u011f\u0131n\u0131 d\u00fczenleyen tebli\u011fde serbest olan lokasyonlarda kurallara uyarak, deniz trafi\u011finden endi\u015fe etmeden, g\u00fcvenle bal\u0131k yakalayabileceklerdir&#8221; denilmekteydi.<\/p>\n<p>Ayn\u0131 tarihte, Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131 da bir yaz\u0131 yay\u0131nlayarak, &#8220;[&#8230;] Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcm\u00fczce \u0130stanbul Bo\u011faz\u0131&#8217;n\u0131n 06 Kas\u0131m 2022 tarihinde deniz trafi\u011fine kapat\u0131lmas\u0131 s\u0131ras\u0131nda yap\u0131lacak bal\u0131k avc\u0131l\u0131\u011f\u0131 faaliyeti Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131m\u0131z\u0131n verdi\u011fi bal\u0131k\u00e7\u0131l\u0131kla ilgili izinler ve yasaklar kapsam\u0131nda icra edilecek olup t\u00fcm faaliyetlerin mer&#8217;i mevzuat kapsam\u0131nda y\u00fcr\u00fct\u00fclmesi zorunludur&#8221; ifadesine yer verdi.<\/p>\n<p>Bu kar\u015f\u0131l\u0131kl\u0131 a\u00e7\u0131klamalar kafalar\u0131 iyice kar\u0131\u015ft\u0131rd\u0131. Bo\u011faz kapat\u0131lacak m\u0131yd\u0131, kapat\u0131lmayacak m\u0131yd\u0131? \u015eayet ilk kapatma karar\u0131ndaki gerek\u00e7e bal\u0131k avc\u0131l\u0131\u011f\u0131ysa ve sonraki a\u00e7\u0131klamalarda bal\u0131k avc\u0131l\u0131\u011f\u0131n\u0131n belirli lokasyonlarla s\u0131n\u0131rl\u0131 oldu\u011fu s\u00f6yleniyorsa, bu kapatma karar\u0131 neden al\u0131nm\u0131\u015ft\u0131?<\/p>\n<p>Bunlar tart\u0131\u015f\u0131l\u0131rken Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131 bir yaz\u0131 daha yay\u0131mlanarak, &#8220;06 Kas\u0131m 2022 tarihinde \u0130stanbul Bo\u011faz\u0131&#8217;nda rutin ge\u00e7i\u015f operasyonu devam edecektir&#8221; dedi. Yani Bo\u011faz&#8217;\u0131n kapat\u0131lmas\u0131ndan vazge\u00e7ildi. Bo\u011faz&#8217;\u0131n neden kapat\u0131laca\u011f\u0131n\u0131 26 Ekim yaz\u0131s\u0131nda detayl\u0131ca gerek\u00e7elendiren bakanl\u0131\u011f\u0131n, kapatmaktan neden vazge\u00e7ildi\u011fini gerek\u00e7elendirmeye ihtiya\u00e7 duymamas\u0131 dikkat \u00e7ekiciydi.<\/p>\n<p>\u00d6zetlemeye \u00e7al\u0131\u015ft\u0131\u011f\u0131m bu tuhaf kapatma a\u00e7ma hadisesi, denizlerimizdeki hak ve menfaatlerimizin temini, korunmas\u0131 ve y\u00f6netilmesi hususlar\u0131nda kurumlar aras\u0131 e\u015f g\u00fcd\u00fcm eksikli\u011fi oldu\u011funu, yetki ve sorumluluk payla\u015f\u0131m\u0131yla ilgili problemler ya\u015fand\u0131\u011f\u0131n\u0131 bir kez daha g\u00f6zler \u00f6n\u00fcne sermektedir.
