BM, Mavi Marmara (Palmer) Raporunun bas\u0131na s\u0131zd\u0131r\u0131lmas\u0131ndan sonra T\u00fcrkiye&#8217;nin \u0130srail&#8217;e kar\u015f\u0131 ilan etti\u011fi be\u015f maddelik \u00f6nlem paketi i\u00e7inde yer alan &#8220;Do\u011fu Akdeniz&#8217;de en uzun k\u0131y\u0131s\u0131 bulunan sahildar devlet olarak, T\u00fcrkiye Do\u011fu Akdeniz&#8217;de seyr\u00fcsefer serbestisi i\u00e7in gerekli g\u00f6rd\u00fc\u011f\u00fc her t\u00fcrl\u00fc \u00f6nlemi alacakt\u0131r&#8221; ifadesi, T\u00fcrkiye&#8217;nin \u00f6n\u00fcm\u00fczdeki g\u00fcnlerde Do\u011fu Akdeniz&#8217;deki etkinli\u011finin artaca\u011f\u0131n\u0131n habercisi gibi g\u00f6z\u00fck\u00fcyor. Bu ifade, Gazze&#8217;ye uygulanan \u0130srail ablukas\u0131n\u0131n T\u00fcrkiye taraf\u0131ndan tan\u0131nmamas\u0131yla ve \u0130srail&#8217;in, BM raporunda yer alan &#8220;Gazze ablukas\u0131n\u0131n yasal oldu\u011fu&#8221; de\u011ferlendirmesini uluslararas\u0131 alanda tan\u0131tmas\u0131n\u0131 engellemekle ili\u015fkili oldu\u011fu kadar, T\u00fcrkiye-\u0130srail-GKRY \u00fc\u00e7geninde enerji kaynaklar\u0131n\u0131n payla\u015f\u0131m\u0131 konusuyla da yak\u0131ndan ilgilidir. EN UZUN KIYI T\u00dcRK\u0130YE&#8217;DE D\u0131\u015fi\u015fleri Bakan\u0131 Ahmet Davuto\u011flu&#8217;nun T\u00fcrkiye&#8217;nin &#8220;Akdeniz&#8217;e en uzun k\u0131y\u0131s\u0131 bulunan sahildar devlet&#8221; oldu\u011funu belirtmesinin elbette bir sebebi olmal\u0131d\u0131r. Bug\u00fcne kadar, K\u0131br\u0131s meselesi sebebiyle, Akdeniz&#8217;de M\u00fcnhas\u0131r Ekonomik B\u00f6lge (MEB) ilan etmemi\u015f olan T\u00fcrkiye&#8217;nin, \u00f6n\u00fcm\u00fczdeki d\u00f6nemde bu ad\u0131m\u0131 atabilece\u011finin ilk sinyali, bu a\u00e7\u0131klama i\u00e7inde aranmal\u0131d\u0131r. Zira MEB&#8217;nin hesaplanmas\u0131nda kullan\u0131lan ba\u015fl\u0131ca kriter, ilgili devletin sahil uzunlu\u011fudur. T\u00fcrkiye&#8217;nin -Ege meseleleri sebebiyle- taraf olmad\u0131\u011f\u0131 ama MEB&#8217;e dair h\u00fck\u00fcmleri genel uluslararas\u0131 hukuk ilkeleri haline gelmi\u015f olan 1982 tarihli BM Deniz Hukuku S\u00f6zle\u015fmesi&#8217;ne (BMDHS) g\u00f6re, T\u00fcrkiye Akdeniz&#8217;deki 12 millik karasular\u0131n\u0131n bitti\u011fi yerden itibaren 200 millik MEB ilan etme hakk\u0131na sahiptir. Di\u011fer yandan, Yunanistan ve GKRY Akdeniz k\u0131ta sahanl\u0131\u011f\u0131nda tek tarafl\u0131 hak iddia etmekte ve ciddi giri\u015fimler y\u00fcr\u00fctmektedir. Prof. Dr. Serta\u00e7 Ba\u015feren&#8217;in bir \u00e7al\u0131\u015fmas\u0131na g\u00f6re T\u00fcrkiye&#8217;nin kendi b\u00f6lgesinde yer alan, 145 bin kilometrekarelik k\u0131ta sahanl\u0131\u011f\u0131n\u0131n, 71 bin kilometrekaresini Yunanistan&#8217;a ve 33 bin kilometrekaresini de GKRY&#8217;ye kapt\u0131rma tehlikesi ba\u015f g\u00f6stermi\u015ftir. KAYNAKLARI ARA\u015eTIRALIM T\u00fcrkiye, Akdeniz&#8217;de MEB ilan etmesi durumunda, sahillerimizden 212 mile kadar uzanan bir sahan\u0131n sular\u0131nda, deniz yata\u011f\u0131nda ve toprak alt\u0131nda &#8220;canl\u0131 ve cans\u0131z do\u011fal kaynaklar\u0131n ara\u015ft\u0131r\u0131lmas\u0131, i\u015fletilmesi muhafazas\u0131 ve y\u00f6netimi konular\u0131 ile; ayn\u0131 \u015fekilde sudan, ak\u0131nt\u0131lardan ve r\u00fczgarlardan enerji \u00fcretimi gibi, b\u00f6lgenin ekonomik ama\u00e7larla ara\u015ft\u0131r\u0131lmas\u0131na ve i\u015fletilmesine y\u00f6nelik di\u011fer faaliyetlere ili\u015fkin egemen haklara&#8221; sahip olacakt\u0131r. Ayr\u0131ca T\u00fcrkiye, &#8220;MEB&#8217;deki canl\u0131 kaynaklar\u0131n ara\u015ft\u0131r\u0131lmas\u0131, i\u015fletilmesi, muhafazas\u0131 ve y\u00f6netimi konular\u0131ndaki egemen haklar\u0131n\u0131n kullan\u0131lmas\u0131nda, s\u00f6zle\u015fmeye uygun olarak kabul etti\u011fi kanunlara ve kurallara riayeti sa\u011flamak i\u00e7in gemiye \u00e7\u0131k\u0131lmas\u0131, geminin denetimi, gemiye el konulmas\u0131 ve hakk\u0131nda dava a\u00e7\u0131lmas\u0131 da d\u00e2hil olmak \u00fczere, gerekli b\u00fct\u00fcn tedbirleri alabilecektir.&#8221; YUNAN\u0130STAN FAAL\u0130YETTE T\u00fcrkiye Akdeniz&#8217;de bug\u00fcne kadar MEB ilan etmemi\u015fken, GKRY 2004&#8217;te 200 millik MEB ilan etmi\u015f ve Akdeniz&#8217;e sahildar baz\u0131 devletlerle, T\u00fcrkiye&#8217;nin tan\u0131mad\u0131\u011f\u0131 MEB payla\u015f\u0131m\u0131 anla\u015fmalar\u0131 yapm\u0131\u015ft\u0131r. Zira BMDHS&#8217;nin 74. maddesi &#8220;sahilleri biti\u015fik veya kar\u015f\u0131 kar\u015f\u0131ya bulunan devletler aras\u0131nda MEB&#8217;in s\u0131n\u0131rland\u0131r\u0131lmas\u0131n\u0131n, hakkaniyete uygun bir bi\u00e7imde, anla\u015fmayla yap\u0131laca\u011f\u0131n\u0131&#8221; \u00f6ng\u00f6rmektedir. S\u00f6zle\u015fmenin taraflar\u0131ndan olan GKRY, bu h\u00fck\u00fcmden hareketle, L\u00fcbnan, M\u0131s\u0131r ve \u0130srail&#8217;le anla\u015fm\u0131\u015f durumdad\u0131r. Dahas\u0131 GKRY kendi MEB&#8217;i olarak ilan etti\u011fi alanda petrol ve gaz arama faaliyetlerini ba\u015flatm\u0131\u015ft\u0131r. T\u00fcrkiye&#8217;nin ABD nezdinde yapt\u0131\u011f\u0131 \u0131srarl\u0131 giri\u015fimlerin sonu\u00e7 vermemesi halinde, bir Amerikan \u015firketinin \u00e7ok yak\u0131nda deniz taban\u0131nda arama \u00e7al\u0131\u015fmalar\u0131na ba\u015flayaca\u011f\u0131 bilinmektedir. AKDEN\u0130Z ENERJ\u0130 KAYNA\u011eI Hal b\u00f6yle iken, T\u00fcrkiye ile \u0130srail aras\u0131ndaki gerginlik, GKRY ile \u0130srail aras\u0131nda do\u011fal bir yak\u0131nla\u015fman\u0131n ortaya \u00e7\u0131kmas\u0131na sebep olmu\u015ftur. T\u00fcrkiye&#8217;nin \u0130srail&#8217;e kar\u015f\u0131 \u00f6nlem paketini a\u00e7\u0131klamas\u0131ndan bir hafta \u00f6nce, 24-25 A\u011fustos&#8217;ta \u0130srail&#8217;i ziyaret eden GKRY D\u0131\u015fi\u015fleri Bakan\u0131 Erato Kozakau-Marcouillis, Ba\u015fbakan Binyamin Netanyahu ve D\u0131\u015fi\u015fleri Bakan\u0131 Avigdor Liberman&#8217;la bir araya gelmi\u015f, g\u00f6r\u00fc\u015fmelerde iki \u00fclke aras\u0131nda imzalanan MEB anla\u015fmas\u0131 da yo\u011fun olarak ele al\u0131nm\u0131\u015ft\u0131r. Ziyaret sonras\u0131 yap\u0131lan a\u00e7\u0131klamalarda, \u0130srail ve GKRY&#8217;nin &#8220;iki \u00fclkenin yarar\u0131na ve uluslararas\u0131 hukuka uygun olacak \u015fekilde Akdeniz&#8217;de enerji kaynaklar\u0131 aramaya ve bunlar\u0131 \u00e7\u0131karmaya en k\u0131sa zamanda giri\u015fecekleri&#8221; dile getirilmi\u015ftir. HAK \u0130DD\u0130A ED\u0130YORLAR Do\u011falgaz ve petrol rezervleri a\u00e7\u0131s\u0131ndan \u00e7ok zengin olan Do\u011fu Akdeniz&#8217;e k\u0131y\u0131lar\u0131 bulunan baz\u0131 devletler \u00e7oktan k\u0131ta sahanl\u0131\u011f\u0131 \u00fczerinde hak iddia etmeye ba\u015flam\u0131\u015f, MEB anla\u015fmalar\u0131n\u0131 yapm\u0131\u015f ve arama faaliyetlerine giri\u015fmi\u015fken, Akdeniz&#8217;e en uzun sahili bulunan T\u00fcrkiye&#8217;nin, \u00fcstelik enerji bak\u0131m\u0131ndan d\u0131\u015far\u0131ya bu kadar ba\u011f\u0131ml\u0131yken, daha aktif olmas\u0131 beklenir. Dolay\u0131s\u0131yla, k\u0131y\u0131lar\u0131m\u0131z\u0131n hemen a\u00e7\u0131\u011f\u0131ndaki bu zenginlikten hakk\u0131m\u0131za d\u00fc\u015fen pay\u0131 alabilmek i\u00e7in en az be\u015f ad\u0131m\u0131 gecikmeden atmam\u0131z\u0131n uygun olaca\u011f\u0131 de\u011ferlendirilebilir. NELER YAPILAB\u0130L\u0130R?.. &gt; Birincisi, T\u00fcrkiye GKRY&#8217;nin, KKTC&#8217;nin haklar\u0131n\u0131 tamamen g\u00f6z ard\u0131 ederek verdi\u011fi arama ruhsat\u0131n\u0131n ge\u00e7ersizli\u011fini teminen uluslararas\u0131 alanda ve ABD nezdinde s\u00fcrd\u00fcrd\u00fc\u011f\u00fc diplomatik giri\u015fimleri yo\u011funla\u015ft\u0131rmas\u0131d\u0131r. Fakat arkas\u0131na AB deste\u011fini de alan GKRY&#8217;nin bu tutumundan cayd\u0131r\u0131lmas\u0131 \u00e7ok m\u00fcmk\u00fcn g\u00f6r\u00fclmemektedir. Kald\u0131 ki, GKRY, tan\u0131mad\u0131\u011f\u0131 KKTC&#8217;yi de bir \u015fekilde s\u00fcrece d\u00e2hil etse, mesela &#8220;K\u0131br\u0131s meselesi \u00e7\u00f6z\u00fclene kadar T\u00fcrk taraf\u0131na d\u00fc\u015fen kazan\u00e7 miktar\u0131n\u0131 uluslararas\u0131 bir hesapta bloke etse&#8221; bile (kald\u0131 ki, b\u00f6yle bir niyetleri zaten yok) T\u00fcrkiye s\u00fcrecin d\u0131\u015f\u0131nda tutulmaya devam edecektir. Demek ki, tek ba\u015f\u0131na GKRY&#8217;yi diplomatik alanda engellemeye \u00e7al\u0131\u015fmak, T\u00fcrkiye a\u00e7\u0131s\u0131ndan istenilen neticeyi do\u011furmaz. &gt; \u0130kincisi, T\u00fcrkiye imzac\u0131s\u0131 olmad\u0131\u011f\u0131 BMDHS&#8217;ye de\u011fil ama uluslararas\u0131 deniz hukukunun genel kurallar\u0131na dayanarak, Akdeniz&#8217;de bir an \u00f6nce 200 deniz mili uzunlu\u011funda MEB ilan edebilir. K\u0131ta sahanl\u0131\u011f\u0131 \u00fczerinde egemenlik haklar\u0131n\u0131 tescil edecek ad\u0131mlar\u0131 atabilir. &gt; \u00dc\u00e7\u00fcnc\u00fcs\u00fc, T\u00fcrkiye ile KKTC aras\u0131nda geciktirilmeden bir MEB payla\u015f\u0131m anla\u015fmas\u0131 yap\u0131p, T\u00fcrkiye Petrolleri Anonim Ortakl\u0131\u011f\u0131&#8217;n\u0131n, T\u00fcrkiye ve KKTC&#8217;nin uygun g\u00f6rece\u011fi &#8220;ortak&#8221; alanlarda petrol ve gaz aramaya derhal ba\u015flamas\u0131 sa\u011flanabilir. \u00c7\u0131kar\u0131lacak gaz ve petrolden elde edilecek gelirin T\u00fcrkiye ve KKTC aras\u0131nda hakkaniyete uygun olarak payla\u015ft\u0131r\u0131lmas\u0131 anla\u015fmayla d\u00fczenlenebilir. Bu ad\u0131m, K\u0131br\u0131s meselesinin \u00e7\u00f6z\u00fcm\u00fc konusunda T\u00fcrk ve Rum taraflar\u0131 aras\u0131nda devam eden g\u00f6r\u00fc\u015fmelerde KKTC&#8217;nin elini g\u00fc\u00e7lendirecektir. &gt; D\u00f6rd\u00fcnc\u00fcs\u00fc, \u0130srail&#8217;in Gazze ablukas\u0131n\u0131 tan\u0131mad\u0131\u011f\u0131n\u0131 a\u00e7\u0131klayarak, Gazze&#8217;nin -deniz alan\u0131yla birlikte- Filistin&#8217;in bir par\u00e7as\u0131 oldu\u011funu kendi politikas\u0131nda resmen tescil eden T\u00fcrkiye, BM Genel Kurulu&#8217;nun \u00f6n\u00fcm\u00fczdeki haftalarda -b\u00fcy\u00fck ihtimalle- Filistin&#8217;i tan\u0131mas\u0131n\u0131n ve BM&#8217;ye \u00fcye yapmas\u0131n\u0131n hemen ard\u0131ndan bu devletle MEB anla\u015fmas\u0131 yapmak i\u00e7in ad\u0131m atabilir. &gt; Be\u015fincisi, son aylarda ya\u015fanan gerginlik sebebiyle bug\u00fcn itibariyle T\u00fcrkiye&#8217;nin Suriye&#8217;yle Akdeniz&#8217;deki MEB payla\u015f\u0131m\u0131 konusunda bir giri\u015fimde bulunmas\u0131 m\u00fcmk\u00fcn g\u00f6z\u00fckmemekle birlikte, \u00f6n\u00fcm\u00fczdeki d\u00f6nemde bu \u00fclkeyle de benzer bir anla\u015fman\u0131n, en az\u0131ndan anlay\u0131\u015f birlikteli\u011finin yolu aranabilir. L\u00fcbnan da ayn\u0131 \u00e7er\u00e7evede de\u011ferlendirilmelidir. T\u00fcrkiye bu manevralar\u0131 yapmazsa, h\u00e2lihaz\u0131rda L\u00fcbnan&#8217;la MEB anla\u015fmas\u0131 yapm\u0131\u015f olan GKRY&#8217;nin \u00f6n\u00fcm\u00fczdeki d\u00f6nemde Suriye&#8217;yle de ayn\u0131 yola girebilece\u011fi g\u00f6zden ka\u00e7\u0131r\u0131lmamal\u0131d\u0131r. SAAT\u0130 DURDURMAK EL\u0130M\u0130ZDE T\u00fcrkiye&#8217;nin bu ad\u0131mlar\u0131 atmakta, \u00f6zellikle Akdeniz&#8217;de MEB ilan etmekte gecikerek, kaybetti\u011fi her g\u00fcn, Akdeniz&#8217;e sahildar di\u011fer devletlerin tek tarafl\u0131 ya da birbirleriyle i\u015f birli\u011fi halinde, T\u00fcrkiye&#8217;nin de hak sahibi olabilece\u011fi alanlarda daha avantajl\u0131 hale gelmelerine yol a\u00e7maktad\u0131r. Bu ise Akdeniz&#8217;in T\u00fcrkiye&#8217;ye b\u00fcy\u00fck \u00f6l\u00e7\u00fcde kapanmas\u0131na sebep olabilir.
